Austin Aggravated Assault Defense Attorneys

Aggravated Assault occurs either when the assault results in serious bodily injury or was committed using a deadly weapon. Aggravated assault is a second-degree felony, punishable by between 2 and 20 years in prison and a fine of up to $10,000.

Just because you have been arrested for assault, does not mean you are guilty. Police will often make an arrest on very little evidence. What To Do If You’ve Been Charged With Assault

Do not talk to the policeexcept to provide identifying information, such as your date of birth or name. The police will say anything to elicit a response from you. They are allowed to lie to you in order to get you to say what they want. Nothing you tell them will help you; it will only be used against you. If questioned, tell them you cannot speak without an attorney present. Do not sign a waiver of your rights.

We base our fee on the complexity of the case. Most of our fees are flat fees. The client is responsible for attorney fees and expenses. We do not take incur expenses without the client’s permission. For some types of cases (especially those that are just in the investigation phase) we charge an hourly rate. If you’ve posted a cash bond that may be applied towards your fee.

Our goal is to avoid a conviction all together. Our secondary goal is to keep you out of jail. This question usually keeps clients awake at night. Without knowing the facts of the case and the criminal history of a client it’s difficult to answer. Generally, for first-time misdemeanor offenders with no criminal history the odds are pretty small that you’ll go to jail. For first-time felony offenders charged with a non-violent offense with limited criminal history also have pretty small odds that they’ll go to jail. The answer varies slightly from county to county.

Our phones are answered 24-hours a day for emergencies. We realize that it’s tough to ask off from work so you can meet with your criminal attorney. That tends to just cause issues with your employment. We’re happy to work around your schedule and can meet virtually or in person.
It depends on the case and whether it’s a felony or misdemeanor but generally cases are resolved in a year to 18 months. Some counties in Texas have a much longer delay and some move quick. Usually, a delay works out to a client’s advantage. We understand that having a criminal matter pending for a long period of time can be stressful. If it gets dismissed in the end, the delay was worth it.
